Vietnam EPR Regulation for Solar Panels: a Guide for Producers and Importers

Extended producer responsibility is now part of doing business in Vietnam. Here is what the EPR law expects from companies that place products on the Vietnamese market, and how verifiable recycling supports compliance.

What the Vietnam EPR regulation says

The Vietnamese regime of extended producer responsibility rests on two main texts: Decree 08/2022/ND-CP and Circular 02/2022/TT-BTNMT, both in force since January 2022 and applied under the authority of MONRE, the Ministry of Natural Resources and Environment. Together they implement the producer responsibility principles of the Law on Environmental Protection.

  • Recycling obligation. Producers and importers must recycle a defined proportion of the products and packaging they place on the Vietnamese market, following mandatory recycling rates and specifications.
  • Financial alternative. Instead of organising recycling themselves, obligated companies can contribute financially to the Vietnam Environment Protection Fund, known as the VEP fund, which finances waste treatment activities.
  • Annual recycling plans. Companies that choose to recycle must declare annual recycling plans and report on their results to the authorities.

In practice this means every producer or importer needs three things: a clear view of the volumes it places on the market, a credible recycling channel or a funded contribution strategy, and documentation strong enough to stand behind its declarations.
